Jeremy De Beer & Mario Bouchard, Canada's 'Orphan Works' Regime: Unlocatable Copyright Owners and the Copyright Board, 10 Oxford University Commonwealth Law Journal 215 (2010): Fascinating empirical overview of how the system works in Canada: I did not realize, for example, how many licenses were granted with contingent payments (payments only if the copyright owner shows up within 5 years).
